Draft — provided for transparency and not a substitute for legal advice.
These Terms govern your use of the squarepixelsoftware.ca website (the “Site”), operated by Square Pixel Software. By using the Site you agree to these Terms. Use of the Frame Archivist application is governed separately by the License Agreement.
Using the Site
You agree to use the Site lawfully and not to:
- interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems;
- probe, scan, or test the vulnerability of the Site without our written permission;
- submit false information (for example, someone else's email on the waitlist), or use the Site to send spam or unlawful content;
- copy, scrape, or republish Site content except as allowed below.
Waitlist and communications
Joining the waitlist means we may email you about Frame Archivist's availability and launch. You can ask to be removed at any time by emailing chris.black@squarepixel.org. Any pricing described as “early access” or “guaranteed” is an offer we intend to honor for waitlist members at launch; it is not a completed sale until you purchase.
Intellectual property
The Site, its content, the Frame Archivist name, and associated branding are owned by Square Pixel Software and protected by applicable law. We grant you a limited, personal, non-exclusive right to view the Site. No other rights are granted.
Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Square Pixel Software and Chris Black will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
Governing law
These Terms are governed by the laws of Alberta, Canada, without regard to conflict-of-law rules. Disputes will be subject to the courts located in Alberta, Canada, except where applicable consumer-protection law gives you rights in your own jurisdiction.
Changes
We may update these Terms; continued use of the Site after a change means you accept the updated Terms.
